The Terms of Service of QuizNe

1. Terms of Use: The use of the Service is prohibited in certain locations. The Service is intended for users of all ages. For children under the age of 13 using our service, parental consent is required. By using the service, you must ensure that (I) all registration information you provide is true and accurate; (II) you must ensure the accuracy of this information; (III) your use of the service does not violate any applicable laws or regulations.

2. QuizNe account and your data: When you create an account on our service platforms, you are responsible for maintaining the security of your account and data, and you are fully responsible for all activities that occur under your account. The account is for individual use, not for organizations, and is only intended for one person. If you notice any unauthorized use of data, your account, or any security breaches, please notify QuizNe immediately for prompt action. QuizNe will not be legally responsible for any actions or omissions on your part, including any damages in any form arising from those actions or omissions. QuizNe may set limits on your data storage over time or use any other measures that QuizNe deems reasonable to manage the service. Over time, QuizNe may also change its policies on providing commercial content or displaying advertisements and may do so without prior notice.

3. The responsibility of contributors: If you create quizzes, post questions and materials on QuizNe, share links on QuizNe, or provide content through QuizNe (collectively referred to as 'Content'), you are fully responsible for the content and all the consequences arising from that content. This applies regardless of whether the content consists of text, images, audio files, computer software, or any other format that QuizNe stores data in or not.

4. Upgrade packages, payments, and cancellation: You can optionally purchase an upgrade package, which provides an enhanced experience with additional features or functionalities for your QuizNe account. You ensure that your registration information, payment details (if you have subscribed to an upgrade package), and any other information you provide to us are true, accurate, and complete. At the same time, you agree to promptly update your information to prevent your plans from being suspended or canceled. You can purchase an upgrade package by (I) paying a regular subscription fee; (II) making a prepayment granting access for a specific period. The following terms will govern your participation in these programs:

• The duration of the prepaid upgrade package: If a new upgrade package is paid for while the existing prepaid upgrade package is still active, the usage time will be added to your account if the previous and newly paid upgrade packages are of the same type. For example, if you are using a GOLD upgrade package and switch to a DIAMOND upgrade package, the duration of the upgrade package will be refreshed, and vice versa.
• When the current subscription period ends, your upgrade package will automatically renew, and you will be charged for the next subscription period according to the payment information you provided. In the event that you do not pay for the upgrade package on time, QuizNe reserves the right to suspend your account or disable features of the upgrade package.
• QuizNe may change the price for the upgrade package. The price change will apply to your next renewal of the upgrade package. Your continued use of QuizNe implies your acceptance of the price change. If you do not agree with the price changes, you have the right to reject them by canceling your subscription before the renewal date of the upgrade package.
• Refunds: Except as required by law, directly purchased upgrade packages through QuizNe are non-refundable. Upgrade packages purchased through other platforms must adhere to the refund policies of those platforms. QuizNe is not responsible for the policies of these platforms. We do not refund the price difference if the upgrade package price decreases or if we introduce the next promotional price, or if we change the content or features of the service.

5. Prohibited content: You are only allowed to upload content related to education, learning, and entertainment. QuizNe reserves the right to suspend or terminate your access to QuizNe if you post illegal or prohibited content on QuizNe. QuizNe may further investigate and take appropriate legal action against anyone violating these terms, at QuizNe's sole discretion, including but not limited to removing violating content from the service, restricting the use of any part of the service, or terminating the account of the violator, or seeking other legal remedies. Prohibited content includes, but is not limited to, content that QuizNe has the sole discretion to determine:

• Unlawful or false information on the internet that violates national security, public order, social safety, and the legal rights and interests of legitimate entities, organizations, or individuals.
• Attacks and encouragement of racial discrimination, disorder, hatred in any form towards any individual or organization.
• Harassment or supporting the harassment of others.
• Exploitation or encouragement of human exploitation through sexual or violent means.
• Contains anything related to explicit sexual content, unrelated nudity not associated with legitimate fields such as art, medicine, or other genuine educational domains, describes or glorifies excessive violence without educational value, or constitutes offensive themes.
• Intentionally seeking personal information from anyone under 18 years old.
• Publicly posting information that causes or creates a risk to privacy or security for anyone, including information about others that you have posted without their consent.
• Violating privacy rights, publicity rights, copyrights, trademark rights, contract rights, or any other rights of any person.
• Containing or advertising information that you know to be false, misleading, or promoting illegal activities or defamatory, threatening, pornographic, abusive, and derogatory behavior.
• Containing or promoting the illegal or unauthorized copying of copyrighted works of others.
• Obtaining passwords or personal identification information for commercial or unlawful purposes from others.
• Related to sending spam, chain letters, bulk unsolicited emails, or instant messages, or junk mail.
• Increasing or encouraging any criminal or risky activities, or providing information instructing illegal activities.
• You can engage in activities related to education, learning, and entertainment when using the service. The following examples are types of activities strictly prohibited on the service. QuizNe has the right to investigate and take appropriate legal action against those who violate these terms, including but not limited to terminating your account or access to the service and reporting to the appropriate authorities, including law enforcement agencies, or seeking other legal remedies. Prohibited activities include, but are not limited to:
Criminal or torturous activities, including child pornography, fraud, trafficking in pornography, drug trafficking, gambling, sexual harassment, stalking, sending spam, sending viruses or other harmful files, violating copyrights, violating patents, or stealing trade secrets.
Breaking, modifying, or attempting to break or modify, encouraging or assisting anyone else to break or modify any security technology or software owned by the service.
Impersonating or attempting to impersonate individuals or organizations.
Using the account, username, or password of another user without their consent or the account owner's permission. Disclosing your password to any third party or allowing any third party to access your account.
Using any information obtained from QuizNe to harass, abuse, or harm individuals or organizations, or attempting to do so.
Activities related to the use of viruses, programs, or any other code, files, or computer programs that disrupt, destroy, or limit the functionality of any software or hardware, or allow unauthorized use or access to a computer or computer network.
Any use of automated systems, including but not limited to the use of scripts to create or post content.
Interfering, disrupting, or excessively burdening the service.
Displaying unauthorized commercial advertisements on QuizNe or accepting payment or anything of value from a third party in exchange for your performance of any commercial activities through the unauthorized or unlicensed use of QuizNe on behalf of that third party.
Using the service in a manner inconsistent with any and all current laws and regulations.
Copying, reproducing, trading, reselling, or exploiting for any commercial purposes, or accessing content or functionalities provided through the service (unless you are authorized to do so in a separate agreement).
• When providing content, you declare and warrant that:
The downloading, copying, and use of the content will not infringe on the intellectual property rights, including but not limited to copyright, patents, trademarks, or trade secrets, of any third party.
If your employer has rights to intellectual property you create, you have: (I) received permission from your employer to post or provide the Content, including but not limited to any software, (II) received assurance from your employer to waive all rights to the Content.
You fully comply with all licenses from third parties related to the content and have taken all necessary steps to successfully transfer any binding terms to end-users.
The content does not contain or install any viruses, malicious software, or any other harmful or destructive content.
The content is not obscene or defamatory and does not violate the privacy or publicity rights of any third party.
In the case that the content includes computer code, it must be properly classified and accurately describe the type, nature, function, and effects of the material, whether QuizNe requires it or otherwise.
• License: Users, when submitting content to QuizNe for inclusion in the service (e.g., by publishing a quiz), grant QuizNe a global, perpetual, royalty-free license (with the right to sublicense) to use, copy, reproduce, modify, adapt, publish, transmit, display, and distribute that content on any and all media. Such use by QuizNe or other companies or individuals collaborating with QuizNe may be carried out without compensation to you for the content you submit, post, or provide through the service.
• Public user content: If you choose to share your content on the public home page of QuizNe, you hereby grant QuizNe a perpetual (as permitted by current law), non-exclusive, sublicensable, transferable, royalty-free, irrevocable, fully paid license to commercialize, use, copy, make available to the public, publish, translate, modify, reproduce, and distribute your public user content through any media, whether individually or in combination with other content or materials, in any form, and by any means, methods, or technologies, whether now known or hereafter created. In addition to the specific rights granted herein, you retain ownership of all rights, including intellectual property rights, to your public user content.
• Responsibility of Service Users: QuizNe cannot review all material uploaded to the service and therefore cannot be responsible for the content, use, or effects of that material. By operating the service, QuizNe does not represent or imply that it endorses the material there posted or that it believes such material to be accurate, useful, or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses and other harmful or destructive content. The service may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The service may also contain material that violates the privacy or publicity rights or infringes the intellectual property and other proprietary rights of third parties or the downloading, copying, or use of which is subject to additional terms and conditions, stated or unstated. QuizNe disclaims any responsibility for any harm resulting from your use of the service or from any downloading by those visitors of content there posted.
• The content posted on other websites: We have not reviewed and cannot review all materials, including computer software, provided through the websites that QuizNe links to, and those links lead to QuizNe. QuizNe has no control over those non-QuizNe websites and is not responsible for their content or use. You are responsible for taking necessary precautions to protect yourself and your computer system from viruses and other harmful or destructive content. QuizNe disclaims any responsibility for any harm caused by your use of non-QuizNe websites.
• Copyright infringement and DMCA policy: Because QuizNe requests others to respect its intellectual property rights, QuizNe also respects the intellectual property rights of others. If you believe that materials placed by QuizNe on the website or application infringe on your copyright, you should notify QuizNe via email at the following address: quizne@abcsoftwarecompany.com. QuizNe will respond to all such notices, including as required or appropriate by removing or disabling access to the material that is claimed to be infringing. In cases where visitors may infringe or repeatedly infringe on QuizNe's copyrights or other intellectual property rights, QuizNe may, at its discretion, terminate or deny access and usage of the services. In such termination cases, QuizNe will have no obligation to refund any amounts previously paid to QuizNe.
• Brand: QuizNe, quizne.com, the QuizNe logo, and all trademarks, services, graphics, and other logos used in connection with QuizNe or the services are registered trademarks and trade dress of QuizNe. Trademarks, services, graphics, and other logos used in connection with the services may be the trademarks of other third parties. Your use of the services does not grant you any right or license to reproduce or use any QuizNe or third-party trademarks.
• Changes: The Service, including but not limited to all available content as well as these Terms and Conditions, may be changed at the sole discretion of QuizNe without notice. You are bound by any such updates or changes, including but not limited to updates or changes affecting these Terms and Conditions, so it is advisable to periodically review these Terms and Conditions.
• Warranty Limitation of QuizNe, Providers, and Licensors: Unless otherwise expressly stated, all content posted or available through the service is provided 'as is,' and QuizNe, its providers, and licensors make no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, specific ownership, or non-infringement of intellectual property rights. You understand and agree that you download or obtain content or services through the service at your own discretion and risk, and QuizNe, its providers, and licensors shall have no legal responsibility or liability for any damages to your computer system or data arising from the download or use of such content or services. Some legal jurisdictions may not allow the exclusion of implied warranties, so some of the above may not apply to you.
• Limitation of Legal Liability by QuizNe, Providers, and Licensors: Unless expressly stated otherwise, in no event shall QuizNe, its providers, or licensors be liable to you or any other party for any direct, indirect, special, consequential, or exemplary damages, regardless of the basis or nature of the claim, arising from any use of the service or its content, or any hyperlinked website, including but not limited to any lost profits, business interruption, loss of data, or other similar cases, even if QuizNe, its providers, or licensors have been clearly advised of the possibility of such damages. In any case, the aggregate legal liability for any and all of your claims against QuizNe, its providers, and licensors shall not exceed the amount you actually paid to QuizNe within the 12 months preceding the date of the compensation claim. Some legal jurisdictions may not permit the exclusion or limitation of liability for certain incidental or consequential damages, so some of the above limitations may not apply to you.
• General Disclaimer and Warranty: You declare and warrant that your use of the service will comply with QuizNe's Privacy Policy, with these Terms and Conditions, with all applicable laws and regulations, including but not limited to any local laws or regulations in your country, state, city, or other governmental area, regarding online conduct and acceptable content, as well as all current laws related to the transmission of technical data exported from the country in which you reside, and any other current policies or terms and conditions.
• Term and Termination: This Agreement will continue to apply as long as you use the QuizNe account, whether it is a free or paid account. QuizNe may terminate this agreement or suspend your access to the QuizNe service at any time, including in the event that you engage in or are suspected of engaging in unauthorized use of the QuizNe service or resources or failure to comply with the agreement. If you or QuizNe terminate the agreement, or if QuizNe suspends your access to the QuizNe service under the agreement, you agree that QuizNe shall have no legal or liability responsibility for you, and QuizNe will not refund any amounts you have paid, to the maximum extent permitted by applicable law. Any license granted to you in the upgrade package not terminated before your upgrade package expires will terminate upon the termination or expiration of the agreement. Sections of the agreement, whether explicit or by nature, shall remain effective even after termination and shall remain in effect upon termination.
